Transportation Reservation Terms & Conditions:
This Agreement is between TO N FRO TRANSPORTATION, LLC, and you, the Client (individually if you are the Client, and/or as agents or guardians of the Client).
GUARANTEE:
Our services provide a satisfaction guarantee. Should you be dissatisfied, please call us. We will do our best to resolve any issues to your satisfaction.
CHANGES TO RESERVATIONS:
We will do our best to accommodate changes to your travel plans. Changes to your pick-up time, pick-up location, and drop-off location may result in a “short notice" change fee of $25. ln rare circumstances, we may be unable to accommodate your request due to availability, in that case, you may keep the original reservation or cancel the reservation. Additional travel and stops beyond the agreed-upon trip distance will result in a fuel surcharge.
WAIT TIME:
There is a 10-minute complimentary wait grace period. After 10 minutes we will charge $15 up to an additional 15-minute wait. If the waiting time surpasses 15 minutes, the trip will be canceled and charged full fare.
Non-airport pick-ups: The waiting time fee will apply after a 15-minute grace period elapsed after the scheduled pickup time.
Domestic Arrivals: The waiting time fee will apply after a 30-minute grace period elapsed after the scheduled pick-up time.
International Arrivals: The waiting fee time will apply after a 60-minute grace period elapsed after the scheduled pickup time.
OVERTIME:
Overtime may be permitted, upon vehicle ability and is not guaranteed. Overtime is billed by the hourly rate and will be collected at the end of the trip by cash payment or charged to the Client’s credit card on file. Overtime rates will be equal to the stated hourly charge and will be charged per hour after the fifteen (15) minute grace period.
PAYMENTS & BILLING:
A deposit must be submitted to confirm the reservation. All deposits and/or any prepayments are NON-refundable. Deposits and/or prepayments may not be transferred to a different vehicle and/or date. If you wish to change a vehicle type & size, you will be required to secure a new deposit. We accept PayPal and all major credit cards: American Express, Visa, MasterCard, and Discover cards. Payment is required in full before or at the time of pick up and is non-refundable in the event any breach results under the terms of this Contract. All credit card transactions will incur a 6% convenience fee.
A NON-REFUNDABLE deposit is required at the time of booking. A cancellation fee of two hundred fifty dollars ($250.00) will be charged to the credit card of the Client on file for any cancellation made within fourteen (14) days of reservation. A fee equal to 50% of the total booking including gratuity will be charged to the credit card on file for any cancellation made within 72 hours of reservation.
All bookings will incur a minimum 20% gratuity assessed to the total charged.
CANCELLATIONS:
All trips canceled within 12 hours of the scheduled pick-up time will be charged full fare. All no-shows will be charged a full fare plus waiting time. If the Client attempts to cancel the Contract after pick-up time, TO N FRO TRANSPORTATION, LLC is authorized to charge the Client's credit card on file for the remaining balance in full.
DAMAGES:
Clients will be liable for any damages that they or any member of their party cause to our vehicle (s). TO N FRO TRANSPORTATION, LLC inspects each vehicle before, during, and after each reservation. In the event of damage to the vehicle (s), the Client assumes full financial liability for any harm and damage caused by the Client or any members of the Client’s party during the service, and the cost of repairing such damage. This includes both interior and exterior damage to repair, replace, and clean the vehicle or any parts of the vehicle. The cost of repairing, restoring, or otherwise remediating any damage to a vehicle caused by the client may be charged to such client’s credit card on file or billed directly to such client, without prior notice.
Additional fees may be charged to cover damages at the discretion of TO N FRO TRANSPORTATION, LLC, and are not limited to the following damages or occurrences:
Smoking in Vehicle – One Hundred and Fifty Dollars ($150.00)
Ripped or Damaged Upholstery or Carpet – Five Hundred Dollars ($500.00)
Vomit or Any Other Bodily Fluid in or on the Vehicle – Two Hundred Fifty Dollars ($250.00)
Lost or Broken Glassware – Twenty Dollars ($20.00)
Excessive Mess in Vehicle – Two Hundred Dollars ($200.00)
Breaking of Television or Air Conditioner – Seven Hundred and Fifty Dollars ($750.00)
Breaking of DVD Player, CD Player, iPod, or Radio – Two Hundred and Fifty Dollars ($250.00)
Opening Fire Window – One Hundred and Fifty Dollars ($150.00)
Opening Fire Window Resulting in Window Coming out and/or Damage – Five Hundred and Seventy-Five Dollars ($575.00)
Any damages found to the vehicle (s) not listed above will be inspected and charged accordingly.
ADDITIONAL TERMS & CONDITIONS:
1.TO N FRO TRANSPORTATION, LLC has the right to terminate service for any form of abuse, behavior deemed inappropriate, or Contract breach, without refund. In case of misconduct, smoking in vehicles, drug use, or any other violation of this Contract by Client or members of Clients party, or if Driver is or feels threatened or otherwise deems the party unruly or endangering the safe operation of the vehicle, Driver has the right to terminate this Contract without any refunds and drop passengers off at the nearest safe location. This is meant for the safety of the TO N FRO TRANSPORTATION, LLC, and the Client. TO N FRO TRANSPORTATION, LLC also reserves the right to expel any person from the vehicle for any reason mentioned above or any other misconduct.
2.The renter must abide by the vehicle (s) capacity. If the driver finds more people than the vehicle (s) capacity, the extra individuals will be asked to leave. The client will be held responsible for exceeding this limit.
3.Dance and/or “Entertainment” poles in the party buses are for decoration/aesthetic purposes only. TO N FRO TRANSPORTATION, LLC is not responsible for any personal injuries or bodily damages incurred due to the use of Dance/” Entertainment” poles or other equipment on the party bus.
4.Alcohol consumption by persons under the age of 21 is strictly prohibited in the vehicle and is prohibited if persons under the age of 21 are present in the vehicle. The TO N FRO TRANSPORTATION, LLC reserves the right to check the identification of any passenger on the vehicle at any time and for any purpose whatsoever. The TO N FRO TRANSPORTATION, LLC reserves the right to refuse service to persons that appear to be under the influence of drugs and or unable to care for themselves or are objectionable to another passenger. No person may use any illegal narcotics or controlled substances in the vehicle. In the event of underage alcohol consumption or illegal drug use, the service will be terminated immediately and without a refund. The client shall be responsible and shall pay for all fines and penalties assessed by state and/or location authorities as a result of the violation of any law by the client.
5.Drug use in the vehicle is prohibited by law. All contraband and items considered “weapons” are strictly prohibited in the vehicle. The TO N FRO TRANSPORTATION, LLC reserves the right to inspect all belongings of minors for alcohol and contraband.
6.Any fines that the TO N FRO TRANSPORTATION, LLC is charged due to the Client's actions will be charged to the Client's credit card on file. These include but are not limited to fines related to underage drinking, over capacity, jumping on top of the vehicle, and throwing trash/littering out of the vehicle. The client is also responsible and will be charged for any parking fees and toll fees incurred during the transporting of the Client.
7.TO N FRO TRANSPORTATION, LLC, its agents, nor its employees shall be liable for any personal property of Client or members of Client’s party, which is misplaced, damaged, stolen, or left in the vehicle.
8.Except in the case of willful misconduct or gross negligence of TO N FRO TRANSPORTATION, LLC, its agents, or employees, the Client hereby waives any claims against TO N FRO TRANSPORTATION, LLC, its agents, or employees for injury, loss, or damage, including consequential damages, to Client or members of client’s party’s person or property from whatever cause. The client waives any right of subrogation about the same and enters at their own risk, and if not comfortable with this, then you will not enter and use TO N FRO TRANSPORTATION, LLC. TO N FRO TRANSPORTATION, LLC is not responsible for injuries that occur while riding in vehicles. Any injury that does occur must be reported immediately to the driver of the vehicle. Injuries not immediately reported are treated as if they did not occur during this contract. Enter at your own risk and give up legal rights by signing this legal document.
9.All reservations are subject to weather conditions. If conditions are deemed by TO N FRO TRANSPORTATION, LLC, to be unsafe, the Client will be contacted with as much notice as possible. Any cancellations due to weather will be eligible for rescheduling at the next available date, or for a refund of the deposit. TO N FRO TRANSPORTATION, LLC does not guarantee arrival at or departure from any point at a specific time due to circumstances beyond its control such as accidents, breakdowns, traffic and road conditions, storms, etc., and shall not be held liable for claims resulting in delays from such conditions. TO N FRO TRANSPORTATION, LLC cannot be held responsible for delays or inconveniences due to unknown and/or unforeseen mechanical failures or situations deemed as “Acts of God”.
10.In the event of a vehicle breakdown, all efforts will be made to supply a replacement vehicle. If a replacement vehicle is sent and/or the client refuses a replacement vehicle, no refund is due. If no replacement vehicle is available, the refund shall be limited to the amount paid by the customer. TO N FRO TRANSPORTATION, LLC is not responsible to fulfill itineraries developed by the Client, which indicate a time that the Client expects to arrive at certain locations after the initial pick-up time.
11.The client is responsible for providing all destination addresses and directions. If the Client requests TO N FRO TRANSPORTATION, LLC to provide such information, TO N FRO TRANSPORTATION, LLC is not responsible for any delays that may result, nor will any concessions be made to remedy time lost.
12.TO N FRO TRANSPORTATION, LLC reserves the right to substitute the reserved vehicle (s) for another replacement vehicle (s) for any reason. TO N FRO TRANSPORTATION, LLC will make a good-faith effort to notify the Client in case a substitution does occur. TO N FRO TRANSPORTATION, LLC will also make a good-faith effort to substitute with a similar type of vehicle.
13.All electronics, amenities, etc. are free. You are only paying for the actual vehicle (s) and transportation. Therefore, we do not guarantee all TVs, lighting, stereo, equipment, etc. will operate at the time of rental. There will be no concessions made if any amenity is inoperable or unavailable.
14.The Client agrees that all terms of this Contract and any disputes arising from this Contract shall be interpreted under the laws of Maryland. The client also agrees that all disputes and claims relating in any way to this Contract including the arbitration of any claim or dispute and the enforceability of this paragraph shall be submitted to and resolved by means of confidential arbitration conducted in the State of Maryland. To the extent not preempted by federal law, the provisions of this Contract shall be enforced by the laws of the State of Maryland, notwithstanding any choice-of-law or conflicts-of-law rules to the contrary. In case of a dispute between the Parties relating to or arising out of this Agreement, the Parties shall first attempt to resolve the dispute personally and in good faith. If these personal resolution attempts fail, the Parties shall then submit the dispute to binding arbitration. The arbitration shall be conducted in the county and state noted in the GOVERNING LAW provision of this Contract. The arbitration shall be conducted by a single arbitrator, and such arbitrator shall have no authority to add Parties, vary the provisions of this Contract, award punitive damages, or certify a class. The arbitrator shall be bound by applicable and governing federal law as well as the law of Maryland. Each Party shall pay its costs and fees. Claims necessitating arbitration under this section include, but are not limited to contract claims, tort claims, claims based on state and federal law, and claims based on local laws, ordinances, statutes, or regulations. The Parties, in agreement with this sub-part of this Contract, waive any rights they may have to a jury trial regarding arbitral claims.
15.The terms constitute the entire Contract between each Client and TO N FRO TRANSPORTATION, LLC with respect to all subject matter covered herein, and supersede all previous communications, representations, understandings, and contracts, either oral or written, between the parties with respect to said subject matter. This Contract or any portion hereof shall not be construed against the drafting party by reason of that party having drafted the Contract or portion hereof. Either party may not modify this Contract except by a written Contract signed by both Client and TO N FRO TRANSPORTATION, LLC.
I (Client) signify that I have read the terms and conditions stated above in this Contract and agree to all stated terms and conditions. I further declare and represent that I am at least 18 years of age, that I have the full legal capacity to be bound by this Contract, and that I am signing this Contract of my own free will and accord.
